New policy in Vietnam: Reduce 30% of exploitation and use fee for environmental data

According to Circular No. 22/2020/TT-BTC, the fee for exploiting and using documents, environmental thematic reports of all kinds is VND 800,000/report (US$34.15); fee for exploiting and using maps of all kinds from VND 870,000 (US$37.14) to VND 4 million/piece (US$170.76); database use fee from VND 460,000 (US$19.64) to VND 9,145 million/piece (US$390); fee for exploiting and using environmental observation data from VND 12,000 (US$0.51) to VND 260,000/parameter (US$11).
However, from May 26, 2020 to the end of December 31, 2020, the fee for exploitation and use of environmental data is only equal to 70% of the above level. This continues to be a solution of the Ministry of Finance to minimize the impact of the Covid-19 epidemic, supporting people and businesses.
Circular No. 22/2020/TT-BTC also stipulates that the fee payers shall pay directly to the fee-collecting organization or remit into the fee-pending account opened at the State Treasury. In case the collection organization collects the fee in the form of non-cash payment, it shall pay the fee according to the charge collecting organization's notice, according to Legal Secretary.
Agencies, organizations and individuals, when submitting dossiers of application for providing environmental information and data at agencies and units specified in Clause 1 of this Article, must pay data exploitation and use charges.

At the latest on the 5th of every month, the fee-collecting organizations must deposit the collected fee amounts of the previous month into account of charges waiting for remittance to the budget opened at the State Treasury.
Fee-collecting organizations being public non-business units may deduct 70% of the total collected fee amount to cover expenses as prescribed in Article 5 of Decree No. 120/2016/ND-CP of August 23, 2016; pay 30% of the collected fee amount into the state budget according to the corresponding Chapter, section, sub-section of the State budget index.
Fee-collecting organizations include: Center for Environment Information and Data under the General Department of Environment (Ministry of Natural Resources and Environment); Agencies assigned by ministries and ministerial-level agencies to provide environmental data and information; Departments of Natural Resources and Environment of provinces and centrally run cities.
The fee-collecting organization is a state agency that remits the whole collected fee amount into the state budget. The source of funding for data provision and collection is allocated by the state budget in the estimates according to the state budget spending regime and norms, according to Financial Magazine.
