Addicts From 12 Sent to Rehab: Ensuring Humanity and Children Rights

The Law on Drug Prevention and Control in 2021 has shown humanity, the Government's attention and care to addicited children, but also a measure to monitor and manage them more closely to ensure children rights.

Accordingly, drug addicts from full 12 years old to under 18 years old are encouraged to register for voluntary detoxification at their families, communities or at detoxification establishments. In case of not registering for voluntary detoxification, the measure of sending to a compulsory detoxification establishment will be applied.

With the number of drug addicts getting younger and younger, to best protect children rights, the Law on Drug Prevention and Control specifically stipulates the preparation of dossiers for sending to compulsory detoxification establishments, separate area, ensuring the right to play and study. Sending to rehab is not an administrative handling measure, so the criminal record is not affected, ensuring children's future development.

In Article 33, drug addicts from full 12 years old to under 18 years old shall be sent to compulsory detoxification establishments when falling into one of the following cases: Failure to register, failing to perform or voluntarily terminating drug detoxification voluntary drugs; during the voluntary drug detoxification period, being detected illegally using narcotics; a person addicted to opiate substances who does not register, does not perform or voluntarily terminates treatment for addiction to opiates with substitute drugs or has been terminated from treatment for addiction to opiates with substitute drugs due to violation of regulations on addiction treatment.

Article 34 of the Law specifically stipulates the preparation of dossiers of request for consignment to compulsory detoxification establishments for addicts aged between full 12 years and under 18 years.

Major General Nguyen Van Vien, Director of the Drug Crime Investigation Police Department (Ministry of Public Security) said that: "Because the old Law did not provide, it is currently not possible to send addicts of this age to compulsory rehabilitation facilities, while the age of addicts is getting younger and younger".

The competence to decide on sending drug addicts from full 12 to under 18 years old to compulsory detoxification establishments is provided by the district-level People's Courts and is not considered to be handling administrative violations. The mandatory detoxification period for this age group is from 6 to 12 months.

Decree 116/2021/ND-CP detailing a number of articles of the Law on Drug Prevention and Control, effective from January 1, 2022, also details the order and procedures for applying measures. compulsory detoxification for people from full 12 to under 18 years old according to the Law on Drug Prevention and Control 2021 in the spirit that this is one of the supportive measures to help children detox, restore their health and behavior. vi to continue studying and become a useful person to society.

To ensure human rights, freedom of movement and residence according to the provisions of the 2013 Constitution and in accordance with the Law on Residence, the Law on Drug Prevention and Control 2021, regardless of subjects subject to handling administrative measures sending into compulsory detoxification establishments between people with stable residence and those without stable residence. That is, all addicts, regardless of place of residence, when found to be addicted, are registered for voluntary detoxification or for treatment of addiction to opiates with alternative drugs.
