Accordingly, in Article 17, agencies, organizations, enterprises, and individuals that have full civil act capacity are allowed to use fireworks in the following cases: festivals, holidays, birthdays, weddings, conferences, opening ceremonies, anniversaries, and cultural and artistic activities. This regulation takes effect from January 11, 2021. Besides, Vietnam's Government has just issued Decree 137/2020 / ND-CP on the management and use of firecrackers. The Decree adds new points about situations where the use of firecrackers is allowed, as well as the prohibited acts of firecrackers.
However, this article also notes that agencies, organizations, and individuals can only buy fireworks from organizations and enterprises that are licensed to produce and sell fireworks.
This decree also stipulates the cases where fireworks are allowed to be displayed, including Lunar New Year, Hung Kings' death anniversary, National Day, Dien Bien Phu Victory Anniversary, Reunification Day, Provinces' anniversaries of liberation, and establishment; national and international cultural, tourist and sports festivals; and other cases decided by the Prime Minister.

Article 5 of the mentioned Decree lists more prohibited acts in the management and use of firecrackers compared to previous regulations.
Accordingly, the acts of researching, manufacturing, buying, selling, exporting, importing, storing, transporting, using, or appropriating firecrackers are strictly prohibited; except for organizations and enterprises under the Defense Ministry that are assigned by the Prime Minister to research, produce, import, export, supply, transport and use fireworks according to regulations.
The Decree prohibits the acts of illegally researching, manufacturing, trading, exporting, importing, storing, transporting, using or appropriating fireworks or firecrackers; illegally carrying firecrackers or fireworks into or out of the territory of the Socialist Republic of Vietnam or into prohibited places, restricted areas, protected areas, and protected targets;
According to the decree, it is also forbidden to exchange, present, give, send, borrow, rent, lease, or pledge firecrackers or fireworks for illegal productions of firecrackers. The acts of transporting, preserving and destroying firecrackers that do not ensure safety or affect the environment; as well as the acts of guiding, training forces to illegally manufacture, produce and use firecrackers in any form are also banned.
As defined in Decree 137/2020, fireworks are manufactured, handcrafted or industrial products that, when subjected to mechanical, thermal, chemical, or electrical excitation pulses, produce sound effects, light, color in space, and does not cause explosions. Low-altitude firecrackers are firecrackers with a diameter of less than 90 mm or a firing range not exceeding 120 meters. High-altitude firecrackers are firecrackers with a diameter of over 90mm or a firing range of over 120m. Firecrackers are products containing crackers that, when under the impact of mechanical, thermal, chemical, or electrical stimulating pulses, cause a rapid, strong chemical reaction, creating an aura that produces sound, light, and color effects in space. Firecrackers may or may not produce the sound of explosions. |
